Arizona Catch 22 Immigration Law


The Governor of Arizona and the state legislature have just passed an immigration law that promotes racial profiling at the local police level. My condolences go out to everyone that is Latino or American Indian that lives in Arizona for all the bullshit traffic stops you are about to endure. Is the law Constitutionally sound? Hell no! Does it make sense? Hell yes! But it makes one obvious point and that is the fact that Arizona is in fact up to its eyeballs in trying to deal with a problem that the federal government has ignored for years. The border is not secure and illegal immigrants are coming whether we like it or not.

When anyone says they are not afraid of the law and would willingly submit to an invasion of their civil liberties then they know that they are not the target of the Arizona law that was just enacted. Is there an illegal immigrant problem in Arizona? There sure as hell is! President Obama should send our military troops to the border and do so immediately. Making any state pass and institute police state laws that are constitutionally wrong is only going to flood the court system with lawsuits by the thousands of people that are and have been life long American citizens. Freedom of travel is an American right instituted by our founding fathers under the Constitution.

When you put the spotlight on this law in Arizona it becomes crystal clear that it is intended to push the federal government to actually do something about the southern border of the country. And the President should act quickly. As blue blooded and liberal that I am, I agree with many of my friends on the right side of the aisle that the federal government needs to step up its efforts to defend and maintain the border.

On the other side of the fence is a nation that actually has to have its military patrolling the streets of every town because the drug cartels are so far out of control. Murder is not only accepted as a common place thing but it has come to the point that a few dead bodies in the downtown districts are the equivalent of a flower box in front of a store.

If the United States government used all of its resources like the IRS to follow the money, Treasury to investigate the money trail, FBI to take the leads and shut down the operation on this side of the border, CIA to find the cartel drug lords and make them go bye- bye, Navy to patrol the shores as if the drug runners were pirates, Army to lay down a world of hell when the drug runners think they can and will overpower the border guards, Marines and Air Force to take the locations where the drug trade originates from and shut it down for good, then the drug cartels will actually fear all law enforcement efforts. Our government and the Mexican government needs to be concentrated on shutting down the cartels and then the majority of the profitable drug trade would end. Then the original cause for the legislation would slow in Arizona. When you follow the money of any issue then you will find the source of the problem.

This should not be a NIMBY issue for the state of Arizona if the President acted to defend the border. Send the troops to patrol our borders rather than the poppy fields in Afghanistan and that would be the end of this discussion.

But I stand by the fact that the law passed and signed by Arizona’s Governor will never pass a lower court test when it is enforced. Freedom of travel is one of the top three of our nations most defended rights.

Mat,
Legal immigrants are already required to carry and present their documents by federal law. Why has this harassment not already been happening?

What part of this law allows stopping someone who looks non white without probable cause?

How have you been traveling without documents? If you board a bus, train, or plane I think you must show documents and certainly to drive.

What is changed aside from preventing local politicians from shielding criminals from the same requirements that law abiding residents and citizens must meet?

This law is opening up the potential for harassment and you know that as well as I do. Have you ever had a friend that is black? Black people get pulled over all the time because of racial profiling and that is wrong? It happens every single day in every single city across the USA Jeff. Lets pass a law saying that old white guys with gray hair are potential criminals and see where Mr. Jeff stands then? Then I'm sure that Jeff would be the first in line to bitch about your Constitutional rights.

Are you suggesting that since racial profiling exists that black motorists should be exempt from requirements to show a drivers license, proof of insurance, or other valid ID? Isn't that what you are saying about criminal aliens?

Again Mat, legal aliens are already required by federal law to have their papers on them at all times and present them when asked. Why should criminals be exempt.

This is like the case in the 60s where a judge ruled that only law abiding citizens could be prosecuted for failure to register their guns in a city that passed gun registration. Criminals would incriminate themselves by trying to register their guns so they could not be prosecuted for not doing so. You want illegal aliens exempt from laws that legal aliens must comply with. You know as well as I do that this is true. (Sounds a little lame doesn't it?) ;)

Do you live in a friging bubble? Yes, Black people get pulled over all the time simply because they are black! Don't be ignorant with your comments! And yes they give the same ID and insurance information you and I as white guys do. Your talking out you ass and refusing to discuss the original post.

This is a white man world and racial profiling exist when it comes to anyone in law enforcement. You apparently do not know anyone that is an African American and I feel bad for you for actually knowing a family or friend that actually is black but then again I am assuming. Jeff, this law opens up Pandora's box for peace officers with an attitude. And you damn well know you have them in your city and every city across America.

So would it be okay with you to have Nazi Germany check points every couple of miles to show your papers? Give me a break Jeff, you know you are pulling my chain.

This isn't by any means Constitutional and you know it.

So by your opposition to my argument according to my original post are you suggesting that our government do nothing Jeff? Or are you just busting me for the sake of being in opposition to a Liberal that is pissed of that the government has done nothing?

Yes, you are assuming, and incorrectly. I have and have had friends who were black. I grew up and have often lived in mixed neighborhoods. I also have friends who are gay. Also, my wife and her family are from Mexico. They spent years of work and waiting to come here legally and are now citizens. Most of the problems they encounter here due to the criminal aliens here. They are in favor of these laws in AZ.

As to the "Nazi Germany check points every couple of miles to show your papers", where do you see this in the law? The original law, the Governor's executive order, and the revisions just passed all prohibit this kind of profiling. Did you make this up again?

When someone is arrested they are required to check citizenship before releasing them. That is a far cry from what you are saying. The purpose of this law is to keep local politicians from preventing the enforcement of Federal law. Again, legal immigrants are already required to carry their papers now. Why should illegal aliens be exempt?

Any law can be abused by bad cops. There are laws to deal with them, you don't need to give up law enforcement. Few laws ingrain as many prohibitions against profiling as this one does. Many of the provisions of the law copy the wording of current federal law.

Mat, Democrats in the federal legislature are right now trying to force through a universal requirement for a biometric universal ID card. If AZ is Nazi Germany then what will this be?

I am not a racist and you would improve your credibility if you did not throw that accusation around quite so freely. You are better than Micheal.

In response to your last comment I want the government to secure the border and enforce immigration law. I want this to reduce crime, increase national security, protect social services and protect the integrity of our elections.

Once this is done we can look at deporting criminals and giving a path to legality to desirable aliens. I would prefer to increase legal immigration but I recognize the difficulty of dealing with those already here.

If you know me you should not ask if I'm disagreeing with you just because you are liberal. None of my comments here have been broad attacks like that. I have usually just taken issue with such things. Do you think I thought you were conservative when we first spoke? I knew your views from seeing you at Chell's blog and linking back. I never commented before because I did not think my opinions would be welcome and I am not a troll.
